TEXAS PROBATE
Probate of a will in Texas is a much simpler process than in most states. The following methods exist in the Texas Estates Code to probate the will of a Texas resident:
  • Probate with an independent executor
  • Probate of will as muniment of title
  • Small estate affidavit
  • Or in some cases no probate is necessary
If the relative did not have a will their estate can still be probated. It becomes necessary for the probate court to determine who the heirs are but the administrator of the estate can still operate independently of step by step court oversight if all the heirs agree.
